Terms of use - Purchasing card

Article 1: TERMINOLOGY
The following terms in these terms of use mean:

  1. “the Card”: the Facq Purchasing Card;
  2. “Facq”: the company that issues the Card;
  3. “the Cardholder”: the legal person in whose name the Card is issued;
  4. “the authorised user”: the employee and/or other person mandated by the Cardholder.

Article 2: USE
Any person in possession of the Card is deemed to have been mandated by the Cardholder. The Card authorises the authorised user to collect products from all Facq outlets in the name of the Cardholder on production of the Card.

Article 3: PROTECTION OF PRIVACY
Facq undertakes not to share the personal data collected with third parties on any grounds. In virtue of the Act of 8 December 1992 on the protection of privacy, every authorised user has a right of access to the database and to have any data relating to him corrected. To this end he shall submit a request to Facq in writing.

Article 4: LIABILITIES
The Cardholder bears sole responsibility for any claims arising from the use of his Card(s) and this until such time as the Cardholder has asked Facq to cancel the Card(s) and Facq has confirmed its/their cancellation. The Cardholder undertakes to pay all the invoices Facq issues for purchases made with the Card(s). Facq cannot be held liable for the harm that may arise from the failure to communicate changes in authorised users or from the provision of incorrect information.

Article 5: LOSS - THEFT
The Cardholder is obliged to notify the company Facq by telephone or email at sales.support@facq.be, during business hours, as soon as he discovers that the Card was lost or stolen and to confirm his report by registered post. Loss or theft within the meaning of the terms of use means any unintentional dispossession of the Card.

However, the Cardholder does remain responsible for any purchases made within 24 hours of the written notification that the Card was lost or stolen.

Article 6: RESERVATION OF RIGHT ON THE PART OF FACQ
Facq reserves the right to refuse the delivery of goods to anyone who presents himself on behalf of the Cardholder who is unable to present the Card.

Article 7: VALIDITY - OWNERSHIP
The card is issued free of charge and is valid for an indefinite period of time. It remains the property of Facq.

Article 8: END OF THE AGREEMENT
Facq is entitled to terminate the use of the Card(s) by the Cardholder at any moment in time and without having to state reasons. The Card shall be returned to Facq on request. The Cardholder is free to terminate the present agreement at any time by returning the Card(s), cut in two, to Facq by registered post. Facq is obliged to confirm receipt of the cut Card(s) in writing. The agreement comes to an end on the day after Facq acknowledged receipt in writing.

Article 9: AMENDMENTS TO THE TERMS OF USE
Facq reserves the right to amend the present terms of use at any time subject to the Cardholder having been notified in writing. Amendments can be disputed within 10 days of the postal date of the notification only unless the Cardholder has returned his Card(s) in the meantime.

Article 10: COMPETENT COURTS
Disputes between Facq and the holder of the Card(s) shall be subject to the exclusive jurisdiction of the courts of Brussels or, where appropriate, to the exclusive jurisdiction of the Justice of the Peace Court of the Second Canton of Brussels.
